Webpify Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Webpify CRM and marketing automation platform, our website, and related services (together, the "Service"), operated by Webpify ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you are agreeing on behalf of a business, you confirm you have the authority to bind that business.

2. The Service

Webpify provides a CRM and marketing automation platform for trades and service businesses, including features such as lead capture, job booking, customer communications, email automation, and marketing analytics and reporting.

We may add, change, or remove features over time as the platform develops.

3. Accounts

To use the Service, you must create an account with accurate and complete information. You are responsible for:

  1. Maintaining the confidentiality of your login credentials

  2. All activity that occurs under your account

  3. Notifying us promptly of any unauthorized use of your account

We may suspend or terminate accounts that provide false information or violate these Terms.

4. Subscription and Payment

  1. Access to the Service requires a paid subscription, billed on the plan and schedule agreed at signup or in your service agreement.

  2. Fees are non refundable except where required by law or otherwise agreed in writing.

  3. We may change our pricing with reasonable notice. Continued use of the Service after a price change takes effect means you accept the new pricing.

  4. Late or failed payments may result in suspension of access to the Service until payment is resolved.

5. Your Data and Content

  1. You retain ownership of all data you input into the platform, including customer records, job data, and marketing content ("Customer Data").

  2. You grant us a license to host, process, and use Customer Data solely to provide and improve the Service.

  3. You are responsible for having the right to collect and process any personal data you upload into the platform, including data belonging to your own customers.

  4. Our separate Privacy Policy explains how we handle personal data.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation

  • Send spam or unsolicited communications in breach of applicable marketing or data protection law

  • Upload malicious code or attempt to interfere with the platform's security or operation

  • Attempt to access another customer's account or data without authorization

  • Reverse engineer, resell, or white label the platform without our written permission

7. Third Party Services

The Service may integrate with third party tools such as Google Ads, Google Analytics, payment processors, and other connected platforms. Your use of those third party services is subject to their own terms and privacy policies, and we are not responsible for their performance or availability.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by Webpify and protected by intellectual property law. These Terms do not grant you any ownership rights in the platform itself, only the right to use it as permitted.

9. Service Availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or changes that temporarily affect availability, and we will try to give notice where practical.

10. Termination

  1. You may cancel your subscription at any time in accordance with your service agreement or by contacting us.

  2. We may suspend or terminate your access if you breach these Terms, fail to pay fees due, or misuse the Service.

  3. On termination, we will provide a reasonable period for you to export your Customer Data, after which it may be deleted in line with our data retention practices.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including fitness for a particular purpose and non infringement. We do not guarantee specific business results, such as lead volume or revenue, from use of the Service.

12. Limitation of Liability

To the fullest extent permitted by law, Webpify will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

13. Indemnification

You agree to indemnify and hold Webpify harmless from claims, damages, or expenses arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify account holders of material changes by email or through the platform. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the Swedish courts, unless otherwise required by applicable consumer protection law.
